Exogenous Testosterone is a Non-Threshold substance. Meaning, the mere presence in the athlete's sample constitutes an anti-doping
violation.

BUT because Testosterone can be generated Exogenously or Endogenously, the confirmation of the Exogenous of the
Testosterone is the task of the IRMS testing. The confirmation procedure does not end, however, with the determination that the
exogenous testosterone is also present in the urine of the athlete. WADA prescribes that the results of an IRMS test will be reported
as consistent with the exogenous administration of a steroid when the carbon-13 to carbon 12 value measured for the metabolite differs
significantly, by 3 delta units or more from the chosen ERC. in addition, the ratio measured for the metabolite must lie below -28%
of that ERC. Even the LAB in applying these thresholds works with varying uncertainty factors in evaluating the results of the IRMS
testing.

It is clear, therefore, on the basis of the TD2004EAAS that thresholds are indeed present and must be taken into account in
the IRMS testing for the presence of Non-Threshold Substances.

As per Dr Catlin testimony, at the time the WADA approved LAB was testing with a criteria of 80% which was the IOC/WADA set threshold (not harmonized though) but there was new information such as the upcoming WADA document that would take into affect the following year. Dr Catlin was trying to convince that the new criteria should be accepted as well as the currently accepted BAP threshold criteria! BAP threshold criteria was accepted in the previous CAS cases and had precedence BUT Dr Catlin said they can go lower based on new evidence.

Did the court say there is no numerical limit or not? Let me know.

The CAS panel accepted other criteria since, as I said, it would come into affect anyways ..... and the UCI rules state that they can use any means as long as they are sound. So as the panel said, those criteria are just as reliable as the BAP criteria.

Dr Catlin testified that the current threshold used was 80%

The CAS said that this is unlike threshold substances and all means can be used.

The other criteria were accepted by the CAS panel since they were going to be coming into the picture in the near future.
